Terms of use

"Site": the esiva.ca website and its subdomains.

"Seller": Ésiva, a business established in Quebec, Canada.

"Customer": any person making a purchase on the Site.

"Products": the clothing and items offered for sale.

"Order": any purchase made by the Customer on the Site.

Order process: select products, add them to your cart, provide shipping information, and proceed to payment. The order is confirmed upon receipt of payment.

Availability: products are offered while supplies last. If an item becomes unavailable after ordering, the Customer will be notified and fully refunded.

Personalization: the Customer is responsible for the accuracy of personalization details provided. Personalized products cannot be exchanged or refunded except for manufacturing defects.

Prices are shown in Canadian dollars (CAD). Applicable taxes (GST and QST) are calculated and displayed at checkout.

Applicable taxes in Quebec: GST (5%) and QST (9.975%).

Payments are processed securely by Stripe. We accept Visa, Mastercard, and American Express.

All transactions are secured with SSL encryption. We do not store credit card information on our servers.

We ship primarily within Canada. Shipping fees and delivery times vary by destination and are shown at checkout.

Delivery times are estimates starting from shipment. Personalized products may require an additional 5–10 business days of production.

A tracking number is emailed as soon as your order ships.

Non-personalized items may be returned within 30 days of receipt in original condition with tags attached.

Important: personalized products (with name, logo, or other customization) cannot be returned or refunded except for manufacturing defects.

To initiate a return, contact info@esiva.ca with your order number. We will provide return instructions.

Refunds are processed within 14 days of receiving the return, to the original payment method.

All Site content (text, images, logos, designs) is the exclusive property of Ésiva or its partners.

Any reproduction, modification, or use without prior authorization is prohibited.

Ésiva shall not be liable for indirect damages resulting from use of the Site or purchased products, to the extent permitted by law.

Our maximum liability is limited to the amount of the order in question.

The collection and processing of your personal data is governed by our Privacy Policy, in accordance with Quebec Law 25 on the protection of personal information.

These terms are governed by the laws of Quebec and applicable federal laws of Canada.

Any dispute shall be submitted to the exclusive jurisdiction of the courts of Quebec.

Ésiva reserves the right to modify these terms at any time.

Changes take effect upon publication on the Site. Continued use of the Site after changes constitutes acceptance of the new terms.
